An informational summary of the patent renewal rules in place for Chinese patents.
Renewal Years
Chinese patent must be renewed annually throughout their granted lifetime. No matter when the patent is granted, renewal fees begin.
Renewal Dates & Payment Windows
The renewal date each year is the anniversary of the filing date of the patent. There is no extended payment window – fees must be paid by the renewal date – by the anniversary of the filing date.
Early payments can only be made up to one month in advance.
Late Payments
Missed renewals do not immediately lead to a lapsed patent. There is a six month timeframe before the patent lapses. In this six months period, the renewal fee can be paid as long as it is accompanied an additional penalty fee. The penalty fee is 25% of the associated renewal fee.
Local Chinese Agent
It’s a requirement of the SIPO that renewal fee payments are made by a qualified agent.
